The Claim Process for Disabled Veteran Benefits
The general process and important deadlines are as follows:
- Vet submits written claim to his or her Regional Office for Department of Veterans Affairs.
- Regional Office sends a letter stating claim acceptance or denial.
- Veteran must mail Notice of Disagreement within one year of receiving denial. This is the first step of administrative appeal.
- Regional Office will review claim file and mail Statement of the Case, which must include reasons for the claim denial.
- Veteran must fill out and submit VA Form 9 within 60 days of receiving Statement of the Case. This is the second step of the appeal.
- Claim is sent to Board of Veterans Appeals. If decision is unfavorable, vet must file Notice of Appeal to the United States Court of Appeals for Veterans Claims within 120 days of receiving decision.
